PRIVACY STATEMENT

Your privacy is very important to Essentialistics. So we will process and use your data securely, in full compliance with the General Data Protection Regulation. In this privacy statement, we explain the information we collect from you and why we do this. We also tell you about your rights in relation to the processing of your personal data. Article 1: Who are we?

Essentialistics is a sole proprietorship, located in (5302 TR) Zaltbommel at 17 Thijs de Torenwachterstraat. We are registered in the commercial register of the Dutch Chamber of Commerce with registration number 61447005. We are a data controller of your personal data.

Article 2: Which data do we use?

We provide you here with an overview of the data we process, why we do this, the legal basis on which we process the data and how long we will store the data.

We process your name, address, place of residence, e-mail, financial data and other data that are required to optimally provide our services to you. We also process your company details and telephone number when you make a business purchase. We use this data to make you a satisfied customer for the duration of our agreement. We store this data for up to 7 years after your last order.

In order to manage your order, we will store your (company) name, delivery address, invoice address, e-mail, telephone number if applicable, purchase history and payment details in our customer database for up to 7 years after the conclusion of our contract. We do this for the implementation of the contract and any changes to or continuation of the contract and to comply with the requirements of the Dutch tax authorities.

We use a portfolio on our website and social media channels to show our products to potential customers. We process the content created by you when you are a promoter and have given permission to do so or when we hire you to take product photos. We store this content in our archive indefinitely, unless you request deletion, in which case a balancing of interests will take place.

For invoicing and financial administration, we process your (company) name with any associated Chamber of Commerce details and VAT number, invoice address, e-mail, telephone number, customer number, payment details and outstanding balance. We are unable to process your payment without this information. We are legally required by the Dutch tax authorities to keep this data for 7 years. After 7 years, we will anonymize your data.

In the unlikely event that you have a complaint about our services, we will process your name, e-mail address, order number, account number and the subject of and communication regarding the complaint in order to find the best possible solution for you. We use this data for an optimal execution of the agreement. We will delete data relating to complaints 7 year after processing.

We have a commercial interest in using some of your personal data for marketing purposes. We process your name and e-mail address for direct marketing. As a consumer, you can optionally also enter your date of birth and Instagram account. When you register as a company, we also ask for your company name and optionally you can leave your phone number, Instagram account and website. We will delete this information as soon as you unsubscribe to our newsletter or indicate that you no longer wish to be contacted by us.

When you participate in a giveaway, we process your name, e-mail and Instagram account. If you want to register a friend for participation, we also process this person's name, e-mail and possibly Instagram account.

We use analytics and retargeting services to make our website possible and optimize it. We have a commercial interest in using your surfing behaviour and related data to analyse our service and improve it where necessary. We will track your use of our website with Google Analytics and are bound by the retention periods of these third parties.

These services use cookies. Cookies are small pieces of information that are sent to your browser when you visit our website and are then stored on the hard drive or on the device you use to visit our website. These cookies will not damage your devices.

In addition, Facebook collects target group statistics using a first party cookie. This information enables us to place more targeted advertisements. These cookies are active as long as we have the pixel installed. However, data collected by Facebook using this cookie is passed on to us anonymously.

We also use the Facebook conversions api. No cookies are used in this process. First party data, such as your name, e-mail address, telephone number and location, are not sent through your browser, but directly from our server to Facebook. We do this to measure the impact of our advertisements and conversion and to improve advertisements with custom audiences.

To enable posting reviews about our services, we process your name, any photo and content of your message. When you place your message via the Feedback Company, this data becomes visible. We may post reviews about our services on our website and social media channels for commercial interest. We will remove these as soon as they are no longer representative of our services or when you make a request to do so.

We process your name, e-mail address, any gravatar image, website and the content of your message when you respond to our articles or messages. This information will automatically become visible and will be kept until you delete your response or we delete our message.

Finally, when you create a personal account, we process your e-mail address in combination with a password, as well as the personal data that you enter in your account. We do this to prevent security fraud and to make it easier for you to pay. We keep this account information until you delete your account, or 7 years after your last order.

Article 3: How do we obtain this information?

We have obtained the above information from you as a customer, contact person or website visitor because you have provided us with this information. In addition, we can process your (address) data when one of our customers wishes to send you a gift or we obtain your details when you have purchased a product from us via one of the platforms where we sell our products, such as Bol.com.

We do our utmost to ensure that data related to minors is only collected with parental consent. If you are convinced that we have collected personal data from a minor without such consent, please contact us.

Article 4: What rights do you have regarding the data?

The General Data Protection Regulation has given you several rights regarding the personal data that we process.

  1. Access - you can request to view your data at any time.
  2. Correct - If you want to have your data adjusted, corrected, supplemented, protected or erased, you can submit a request to do this. You can also adjust several details in your personal account.
  3. Objection - You can object to the processing of your data based on a weighing of interests.
  4. Data transfer - If you want to transfer your data to another provider, we will provide your data in a structured and commonly used form that can be accessed by common digital systems.
  5. Withdrawal – If we have processed data based on your explicit consent, you have the right to withdraw your consent. This may have consequences for the services we are able to provide.

To exercise your rights, please send a request accompanied by a copy of your ID (with your citizen service number (BSN) obscured and photograph) to hello@essentialistics.com. We will assess your request as soon as possible, but at the latest within 30 calendar days. If we are unable to comply with your request, we will let you know why we are refusing your request.

Article 5: Who receives your data?

We will not provide your data to third parties, unless it this necessary for business operations or is required by law. In order to implement the agreement, your data may be passed on to processors, parties involved in implementing the agreement and external advisors. We enter into processing agreements with these third parties to protect your privacy as effectively as possible. We will not sell your information to third parties.

In the event that we process your data outside the EEA, we will take appropriate (security) measures.

We recommend that you review this privacy statement regularly, as we may make changes from time to time. A cookie is only created on the first visit; on subsequent visits the existing cookie is used. We use JavaScript to count page views. This enables us to determine which content interests you most as a visitor. Cookies placed by Google Analytics are stored for two years.

However, protecting your privacy is very important to us. So we have taken the following measures with respect to analytical cookies to maximize your privacy:

We have entered into a processor agreement with this provider. We have agreed that they will not use your data for other purposes. We also hide part of your IP address. Because the statistics are collected anonymously, no permission is requested for the placement of analytical cookies.

Tracking cookies

We use tracking cookies from third parties, including Facebook and Pinterest, on the website to be able to make personalized offers based on your surfing behaviour. If, after visiting our website, you visit another website with the same ad reach, your device will be recognised. This enables us to show our advertisements on that other website. However, we only use this information to show you those advertisements and will not link it to other files.

Finally, the embedded content on this website may contain marketing cookies. For example, we have displayed our Instagram feed on the website. Data about you as a user is only sent to Instagram when you click on the photos. The data collected using this cookie is not accessible to us as website owners. You can choose not to consent to the placement of these cookies. However, this will automatically mean that you are unable to view the embedded content.
